HOUSTON: Only 39 Apartments will take a Felon until year 10

Only 39 Places until Year 10

Well, 39 total places for a felony conviction are available. But what applies to you will certainly be less than that number.  Location, price range, availability, and the "crime and time" restriction will certainly affect your choices.

What do I mean by CRIME & TIME?  Many apartments have a rule on when they will consider you for an apartment.  Usually the more "distasteful" a crime is creates their guidelines.  Let me give you 3 examples:

1. A hot check felony may be accepted at year 1 by some complexes since they view their risk as minimal (they will insist that you pay with a money order).

2. A marijuana possession crime may be accepted by some complexes at year 5.  However a dealing or distribution crime may not be accepted until year 10.

3. Some complexes will never take an aggravated felony (weapon or threat used in a crime) or violent crime while others wait for 10 years.

GENERAL INFORMATION: Deferred Adjudication - FINALLY FOUND A MGR THAT UNDERSTANDS IT

FINALLY - An Apartment Manager that Understands what a D.A. is,
and what it isn't

As I detailed in yesterday's blog, I was frustrated by an apartment manager believing her courtsey officer who told her a Deferred Adjudication for a Felony is a finding of guilt - thus a conviction.

The word DEFERRED ADJUDICATION means that the judge does not render a finding of guilt but defers such finding until a later time. It is, in a sense, a time out.  Time to see if it was a aberration, a misunderstanding before a person is permanently branded as "a felon".

The probationary period gives the individual the chance to show that it was a mistake.  I know many of my client's were not guilty but couldn't afford a lawyer, or couldn't afford the small chance that a jury would find them guilty (mothers of small children and the working poor often chose this route).

Finally found a manager that understands.  I guess that the one that didn't yesterday will fade into memory.  I'm going to remember the one in San Antonio that understands.

She is a real winner in my eyes.  I will work to fill up her complex.

GENERAL INFORMATION: Apt managers mislead by their own "Courtesy Officers"


I get SOOOOO Frustrated with Apt Managers who don't understand a D.A. 

Today's frustration of the day was caused by an apartment manager in San Antonio.  She had been "mis-informed" that a DA was the same as a conviction. Her "courtesy officer" is the one who told her it was "just a conviction by another name".

The law-makers and Judges in the State of Texas didn't have that in mind when they crafted the law.  Here is an excerpt from the TEXAS BAR web site:





What is deferred adjudication?

Deferred adjudication is a special form of judge-ordered community supervision (commonly known as “probation”) that p
ermits the defendant to accept responsibility for a crime without automatically suffering all of the consequences of a formal finding of guilt and sentence. The judge literally defers a decision on the defendant’s guilt, places the defendant 







on a period of supervision, and imposes certain contractual conditions designed to rehabilitate or punish the defendant 
and protect the victim and the public.





















The difference between “regular” probation &
 deferred adjudication




Texas law provides that, depending on the offense, a criminal defendant may be placed on one of 2 types of probation: 
regular or deferred adjudication.










Regular probation requires a finding of guilt (conviction) for the crime followed by a 
specific punishment of confinement and/or fine (sentence) that is then suspended.





A defendant placed on deferred adjudication avoids a conviction or sentence because the judge is authorized to delay any finding of guilt or punishment for as long as the defendant successfully complies with the conditions of supervision.





What are the pros and cons of deferred adjudication?

A defendant placed on deferred adjudication can avoid a formal conviction and punishment. However, that does not 
mean there will never be any negative consequences.... A violation of supervision could expose the defendant to substantial punishment without a jury trial and with no right to appeal the judge’s decision to adjudicate guilt.





My Feelings


Since our law-makers in TX have deemed that a Deferred Adjudication is NOT A CONVICTION, I don't see any reason that a courtesy officer would mis-lead an apartments manager.  I can only surmise that the officer is ignorant of the law or is frustrated with "arresting people who then receive a DA".

Fred Dahr, noted Houston Criminal Defense Attorney, has a blog article that is worth reading in which he states the Number 1 Texas Legal Myth:


"the number one myth in Texas criminal law is "finish your deferred and the offense disappears. It's like it never happened." This lie is told to defendants every day in every court house in every county in Texas."

I would tell you, as an apartment locator, is that Apartments will also know and if you don't have a locator, like myself, that specializes in helping people with D.A.'s -- that you will be turned down.  And turned down often. There are only a handful of apartments in each metro area of TX that will accept your DA that won't accept convicted felons.
